1. Operator
These terms and conditions govern the contractual relationship between participants and:

2. Booking & payment
Bookings made via FareHarbor are confirmed immediately upon payment. Bookings made directly by phone, email, or WhatsApp are confirmed once we send a written confirmation.
Payment for online bookings is collected by FareHarbor at the time of booking. Direct bookings are payable in cash or by bank transfer as agreed at the time of confirmation. A 6% booking fee applies to all FareHarbor transactions; this fee is waived for direct bookings.
Prices are quoted in euros (€) and are per person unless otherwise stated. Private tour prices are quoted per group.
3. Cancellation & refunds
Public tours: Free cancellation up to 24 hours before the scheduled start time. Cancellations made within 24 hours of the tour are non-refundable. If you cancel within 24 hours but contact us before the tour starts, we will do our best to transfer your booking to another date subject to availability.
Private tours: Free cancellation up to 24 hours before the scheduled start time. Cancellations made within 24 hours are non-refundable. Rescheduling within 24 hours is possible at no extra charge subject to availability.
Refunds for eligible cancellations are processed via the original payment method within 5–10 business days.
4. Tour cancellation by us
We reserve the right to cancel a tour in the event of dangerous weather conditions (storm, lightning, severe frost), civil unrest, or circumstances beyond our reasonable control. In such cases, all participants will receive a full refund or the option to reschedule at no charge.
Tours operate in light rain — Hamburg is a northern maritime city and outdoor activities continue in typical Hamburg weather. We do not cancel for drizzle or overcast skies.
If a public tour does not reach the minimum booking threshold (1 confirmed participant), we reserve the right to cancel with a full refund.
5. Group size & conduct
Public tours are capped at 15 participants. We reserve the right to refuse entry to or remove from the tour any participant who is disruptive, intoxicated, or behaves in a way that interferes with the experience of other participants. No refund is due in such cases.
Participants are responsible for keeping up with the group. We are not liable for participants who separate from the group during the tour.
6. Health, fitness & accessibility
Tours involve approximately 3 km of walking at an easy pace over flat terrain. Participants should be able to walk continuously for up to 2–2.5 hours. The Old Town and St. Pauli routes are fully paved and accessible to wheelchair users and pushchairs. The Speicherstadt route passes through a historic district with predominantly cobblestone streets.
Participants with reduced mobility, health conditions, or specific accessibility requirements are encouraged to contact us before booking so we can advise on suitability.
Children under 15 must be accompanied by a responsible adult throughout the tour.
7. Liability
Participation in our tours is at your own risk. We are not liable for personal injury, loss, or damage to property arising from participation in the tour unless caused by our gross negligence or wilful misconduct.
We are not liable for loss or theft of personal belongings during a tour. Participants are advised to keep valuables secure at all times.
Our liability for any claim arising from a booking is limited to the price paid for that booking.
8. Changes to bookings
We reserve the right to make minor changes to tour routes, timings, or content for operational, safety, or weather-related reasons without prior notice or compensation. Material changes (e.g. a change of meeting point by more than 500 m) will be communicated as soon as possible by email or phone.
9. Photography & intellectual property
Tour participants may photograph and film the tour for personal, non-commercial use. Sharing on social media is welcome. Commercial use of photographs or videos taken during a tour requires prior written consent.
All tour content, narratives, and materials produced by Moin Hamburg Tours are protected by copyright and may not be reproduced for commercial purposes without permission.
10. Governing law
These terms are governed by the laws of the Federal Republic of Germany. The courts of Hamburg have exclusive jurisdiction over any disputes arising from these terms or from a booking with Moin Hamburg Tours, to the extent permitted by applicable law.
For EU consumers: nothing in these terms affects your statutory rights under applicable consumer protection law. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr/. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board, but we are willing to do so in individual cases.
11. Changes to these terms
We may update these terms from time to time. The current version is always available on this page. Bookings made before a change in terms are governed by the terms in force at the time of booking.
